The Canadian Horse/Le Cheval Canadien is Canada’s National Horse and is endangered. Although this can mean it is important to keep as many horses as possible available for breeding, mares of breeding age are not to be bred if (1) they are not registered and/or have been removed from the Canadian Horse herd book on CLRC, (2) the stallion is not a purebred and registered Canadian Horse, as both of these instances result in foals that cannot be registered and, therefore, are at risk of becoming one of the thousands of grade horses that have little market value and are too easily discarded. *
When breeding, it is crucial to: (1) do due diligence to find a suitable mate for this horse (e.g., complementary conformation, diverse bloodlines) to ensure a quality, marketable foal is produced, (2) pursue registration of all purebred foals, and (3) ensure the proper paperwork is completed and filed with CLRC upon the sale of any offspring. *
The horse is being adopted/purchased as a “companion” and not for the purpose of training then re-selling for profit, factory farming or breeding, slaughter, or any purpose or circumstance that may be considered questionable. *
The adopted horse will not be sold, bartered/traded away, loaned out, given away, abandoned or otherwise leave your possession for a period of one year following its adoption. Should you no longer want, or find that you can no longer keep, the horse within the first year, CHRRS will be notified and the horse immediately returned to CHRRS; upon return of said horse CHRRS will reimburse the initial adoption fee. After one year, should you decide to sell the horse CHRRS will be notified immediately and given the option to purchase the horse, at a price to be negotiated. *
You are capable of providing proper shelter from the elements (e.g., rain, snow, sun), keeping fresh water accessible at all times, and feeding a sufficient amount of wholesome food (e.g., grain, pellet feed, and/or quality hay, as needed) at least every 12 hours. Ideally, the horse should have access to grazing or local hay on a free-will basis. However, attention must be paid to ensure weight control, since Canadians are typically very easy keepers and excess weight can lead to founder, insulin resistance, and other health issues. If paddocks are used, slow feeders (nets, boxes) can allow a more natural access to forage throughout the day. *
A CHRRS director, or one of its representatives, may inspect the premises where the animal(s) will be, or are currently being kept, for the period of 1 year following the adoption, to ascertain that the animal is well cared for. Under normal circumstances CHRRS will give prior notification of its intent to inspect, but reserves the right to make unannounced visits as it deems necessary. Should you need to move the adopted horse to a new location within 1 year of adoption, you will notify CHRRS of the new address of the barn. *
If you fail to comply with any of the statements in this agreement, or if CHRRS determines that the situation is undesirable for the well-being of the adopted equine according to the terms of this agreement, CHRRS will make a reasonable attempt to assist you in meeting these terms. Should such attempts fail to correct the situation, you agree to return the horse to CHRRS, at which time CHRRS will reimburse the adoption fee. Should the equine be with foal, both will be returned to CHRRS. *
CHRRS has shared all the information it has about the adopted equine and makes no representations or guarantees about the soundness, abilities, temperament, or health of the adopted equine. Once this agreement has been signed, and the horse placed in your care, you agree to accept all responsibility for any action or lien resulting from any action, directly or indirectly involving the horse and/or assume any and all medical costs. *
Neither CHRRS nor its employees or agents will be liable for any damages or injury caused to you or any third person by your adopted horse once you receive delivery of said horse, including but not limited to damages or injuries caused by the fact that the horse does not behave or perform in the manner expected. If any third person makes a claim against CHRRS or any of its agents as a result of any conduct of the horse in your possession, you agree to indemnify and hold harmless CHRRS, its directors, officers, and agents from any such claim, including any/all costs resulting from such claim. *
This agreement shall be legally binding upon you, your heirs, estate, assigns, including all minor children, and personal representatives and it shall be interpreted according to the laws of the Province of British Columbia, Canada, being CHRRS’ principle location. Any dispute under this agreement shall be litigated in, and venue shall be, the British Columbia Provincial Court. If any clause, phrase, or word is in conflict with Provincial law, then that single part is null and void. *
You understand that CHRRS will immediately proceed with legal action against you should any attempt be made on your part to deny immediate access to the equine, for 1 year following adoption, upon a request by a representative of CHRRS or for any violation of any terms of this agreement. Should you deny or fail to provide immediate access to your adopted equine when requested you will bear all costs of enforcement of this agreement. Once an equine has been placed, this will become a binding agreement between the adopted home described above and CHRRS. *
